Agreement to Terms
These Terms & Conditions govern your use of the Black Atlas website and services operated by Black Atlas Systems("we," "us," or "our"). By accessing or placing an order on Black Atlas, you agree to these terms. If you do not agree, do not use the service.
These terms, together with our Privacy Policy and any order-specific confirmations, form the agreement between you and Black Atlas Systems for use of Black Atlas.
Use of the website
You may browse products, create an account, and purchase electronics, gadgets, and related accessories for personal or legitimate business use, subject to these terms and applicable law.
- Do not misuse the site, attempt unauthorized access, or disrupt our systems
- Do not scrape, reverse engineer, or copy our content beyond normal browsing
- Do not use Black Atlas for unlawful, fraudulent, or abusive activity

Accounts and responsibilities
Account security
You are responsible for keeping your login credentials confidential and for activity under your account. Notify us promptly of any suspected unauthorized use.
Accurate information
Provide accurate contact, shipping, and billing details so we can fulfill orders and reach you about delivery or support.
Suspension
We may suspend or terminate accounts that violate these terms, attempt fraud, or abuse Black Atlas or other customers.
Products and orders
Catalog accuracy
We aim for accurate descriptions, images, and specs for electronics and accessories. Minor differences, manufacturer updates, or listing errors may occur. Availability is not guaranteed until an order is confirmed.
Pricing
Prices are typically displayed in Kenyan Shillings (KES) and may change without notice. We may cancel or refuse orders with obvious pricing or stock errors and will notify you if that happens.
Order acceptance
Placing an order is an offer to buy. Black Atlas Systems may accept, decline, or limit quantities for any lawful reason (including stock, fraud checks, or shipping limits).
Cancellation
You may request cancellation before dispatch where still possible. Once shipped, returns follow our returns policy below.
Payment and billing
Accepted methods
Black Atlas may offer M-Pesa, card payments (via providers such as Stripe or Paystack), cash on delivery, and other methods shown at checkout. Availability can vary by order and location.
Security
Payments are processed by certified partners. We do not store full card PAN or M-Pesa PIN data on our servers.
Taxes and fees
Displayed totals may include applicable taxes or fees. Additional shipping charges may apply based on destination and method.
Shipping and delivery
Delivery estimates
Times shown at checkout are estimates and may vary with stock, carrier performance, and destination (especially outside major Kenyan cities or for international routes, if offered).
Risk of loss
Unless mandatory law provides otherwise, risk passes according to the shipping terms applicable to your order. Report transit damage promptly with photos so we can assist with carrier claims or replacements.
Customs
For any cross-border shipment, duties, taxes, and clearance requirements in the destination country are generally your responsibility unless we expressly state otherwise.
Returns, refunds, and warranties
Returns
Eligible unused items in original packaging may be returned within 30 days of delivery, subject to inspection and stock restoration rules. Activated software licenses, sealed items opened where hygiene or security seals apply, or goods damaged by misuse may be excluded.
Wrong or damaged items
Contact us within 48 hours of delivery with your order number and photos. We will arrange repair, replacement, exchange, or refund as appropriate.
Refunds
Approved refunds are issued to the original payment method where possible, typically within several business days after we receive and inspect the return.
Warranties
Manufacturer or store warranties (if any) are described on the product page or with your order. Keep your invoice for claims. Warranty does not cover accidental damage, misuse, or unauthorized modification unless the warranty terms say otherwise.
Limitation of liability
To the fullest extent permitted by law, Black Atlas Systems and Black Atlas are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity, arising from your use of the website or products—except where liability cannot be limited under mandatory consumer protection law.
Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or other liability that cannot lawfully be excluded.
Changes to these terms
We may update these Terms & Conditions from time to time. Material changes will be reflected on this page with an updated date. Continued use of Black Atlas after changes take effect constitutes acceptance of the revised terms, except where mandatory law requires additional notice or consent.
Governing law
These terms are governed by the laws of Kenya, without regard to conflict-of-law rules that would apply another jurisdiction's law. Disputes shall be subject to the courts of competent jurisdiction in Kenya, unless mandatory consumer rules provide otherwise.
